On Monday, The Supreme Court denied to review a case that could have allowed some States to block abortion providers like Planned Parenthood from Medicaid funding. According to Politico, the petitions came from the States of Kansas and Louisiana, who were looking to block funding to Planned Parenthood. Politico reports that 6 Justices voted to turn away the petitions, including Chief Justice John Roberts, and recently confirmed Justice Brett Kavanaugh. Justice Clarence Thomas along with Justices Alito and Gorsuch dissented. Now, all around this ruling is disappointing, and are just one of the reasons why Roe v Wade should be overturned, but it probably won’t due to Justices like Roberts and Kavanaugh who has received a lot of attention today. Now is it disappointing to see him rule this way? It is, but is it surprising? No it isn’t and let me explain.
When Justice Anthony Kennedy retired back in July, President Trump had a significant opportunity to appoint another conservative judge to the Supreme Court, particularly one that would have voted to overturn Roe v Wade. On the list of 5 possible nominees President Trump had, the only Judge that would definitely voted to overturn it would have been Judge Amy Barrett. The other 4 were a little dicey when it came to this subject. The one who was the most dicey was Judge Brett Kavanaugh. He has had several cases where he ruled in similar fashion to this one. He has said repeatedly that Roe V Wade is set precedent, which really has no constitutional authority but is often used by Judicial Judges. Of course there were cases involving the 2nd amendment for example whereas he did rule conservative in, but overall he wasn’t the best pick. But of course, President Trump nominated him. Look, was he an absolute horrible choice? No, he was a decent nominee, but he wasn’t the best and I think most conservatives felt this way. That’s why you are seeing conservatives saying what I’m saying that this wasn’t surprising, meaning we knew this would happen. And look, I know it could be easy to forget this due to the polarized political environment. During the debacle we had back in September with Kavanaugh, we all put aside the issues we had with him in order to defend him against false allegations, which isn’t necessarily a bad thing. The Left on the other hand has reacted in an interesting way, and let me explain.
Several people on the left on Twitter were actually quite gleeful with this ruling. Not only were they happy with the liberal judges, they were even happy with Kavanaugh. They were glad that he ruled in their favor. It’s as if they just realized that he wasn’t planning on overturning Roe v Wade. Uh huh, yeah, so, are we supposed to pretend that nothing happened back in September? Are we supposed to pretend that the same left praising him today didn’t try to destroy his life and career based on unverified allegations of sexual assault? Sorry guys but you can quit that crap out. You are not going to sit there and pretend as if nothing happened. What’s hilarious about this is that the reason why the left trotted out these uncorroborated allegations was because they were willing to do anything to protect the act of killing babies, even though Kavanaugh never suggested he would do so. All this was is just more Hypocrisy from the left.
In the end, I think we should expect more rulings from him similar to this. I don’t think he’s going to be a full blown Kennedy but he’s going to be more like Justice Roberts than anybody. Who knows though, maybe sometime soon, Justice Ginsburg will retire and then Trump will nominate Amy Barrett. At that point there will be enough votes to overturn Roe v Wade and possibly Barrett’s vote could influence Kavanaugh, which would be great.
